AGREEMENT REGARDING MINIMUM WAGE FOR LABOUR IN KARNATAKA TELEVISION INDUSTRY

as per the decision of the general body on 13th July 2003

 1.  Meaning of the term LABOUR in Karnataka Television Industry.

 The following categories of persons providing manual labour are treated as LABOUR by Karnataka Television Association.

  • Light Assistants
  • Light Assistants (Special, HIM, Crane Operators and Round Trolley Operators)
  • Light Technicians/Electricians
  • Generator Operators
  • Asst. Gen. Operators
  • Generator Vehicle Drivers
  • Production Assistants
  • Asst. Dress man
  • Make-up Assistants
  • Art Assistants
  • Camera Assistants
  • Dubbing Assistants
  1. Working Shifts for Labour

The Gazettes of the State and Central Governments have stipulated the following hours as shifts for the personnel providing labour in television industry.

 Part I.

  1. 1st Shift :  9 AM to 6 PM with lunch break between 1 PM to 2 PM.
  2. 2nd Shift:  6 PM to 2 AM with lunch break between 9 PM to 10 PM.
  3. 3rd Shift:  2 AM to 6 AM without any breaks

 Part II

  1. 1st Shift:  6 AM to 2 PM with breaks between 8 AM to 9 AM and 1 PM to 2 PM
  2. 2nd Shift: 2 PM to 9 PM with a break of half hour in between
  3. 3rd Shift:  9 PM to 6 AM with a break of one hour in between

Time spent for traveling is not treated as duty.  In case the employer is unable to provide breaks during the above said shifts, the period is to be treated as overtime and the labourer is entitled for overtime allowance for such work.

3.  Principles for determining Minimum Wage

The sub-committee constituted by KTA under the president ship of Sri. Ashok Naidu has made recommendations based on the existing rules framed by the National and State organizations for film industry labour and the orders passed by the Government of Karnataka during 1992.  The recommendations were discussed with various labour representatives and as per the decision of the general body on 13th July 2003 the KTA has fixed the following as minimum wage.

In case of Daily and Mega Serials, General shift from 9 AM to 9 PM is to be treated as one and half shift for light, photography and sound recordist categories.  For other categories, minimum wage as per the above table is to be considered. 

 4.  Wage disbursement procedure                                                     

Wages are to be paid on the particular day itself.  However, if the shooting is for continuous as in the case of shooting of serials etc., the wages can be paid at the end of every week i.e., on Saturdays.  At no point of time should the wage kept pending for more than two weeks. 

5.  Monthly Payment of Wages

  1. A minimum of 26 working days are to be considered for monthly payment.
  2. A days holiday is to be given for every week.
  3. Additional wages are to be paid for work done on Sundays and General Holidays.
  4. Workers are entitled for Provident Fund benefits where the total number of workers exceeds 8 workers.

6.  General Guidelines

  1. Producers must ensure that they employ only KTA members.
  2. Trainee workers provided by KTA are not eligible for wages.  However, they must hold temporary membership of  KTA for a minimum of 3 months to become eligible for permanent membership.

7.  Duties & Responsibilities of Workers

  1. Workers must be fully prepared for shooting and ensure that the shooting runs smoothly.
  2. Workers must keep the Identity Card of KTA during working hours.  Those not having will be summarily dismissed from work and are also liable for fine. 

  3. Workers found misbehaving in any way including consumption of alcohol and other related intoxicated things shall be suspended for a period of one week apart from being fined.

8.  Responsibility of Producers in case of Accidents Etc.

  1. Producers must bear the medical expenditure for accidents where the expenditure exceeds the Insurance and  Welfare Fund of KTA.

  2. Producers must bear the cost of food during working hours and provide lodging facilities for outstation work.

9.  Dearness allowance for outstation work

  1. The following allowance is to be paid for outstation work as TA.

For distances of more than 100 Kms but less than 300 Kms

TA equal to one shift wage

For distances of more than 300 Kms but less than 600 Kms

TA equal to two shifts wage

 

  1. Free lodging & boarding facilities to be provided to every member.
  2. Rs.15/- per day is to be paid as outstation allowance.  Rs.25/- in case of hill stations.

10. Relief for working without break

Rs.15/- is to be given as special relief when the work is continuous without giving time for lunch etc. apart from providing food for the workers.  In case of night shifts, Rs.25/- is to be given as relief.

11. Relief for working on Sundays & other Holidays

  1. KTA declares a total of 10 days as holidays in a year.  Workers are entitled for double wages for working on such holidays.

  2. Workers are entitled for double wages for working on Sundays.

 Second Sunday is declared as holiday by KTA for all activities.  However, the following concessions are given for Daily Serials and Documentary Producers.

  1. Producers of Documentaries may take the services of Photographers, Dubbing Workers on Second Sundays and all other categories of workers including actors, anchors are barred from working on Second Sundays.

  2. Producers of Daily serials may continue work on second Sundays after taking prior permission from KTA in writing after donating Rs.750/- to KTA Welfare Fund..

12. Minimum No. of light Assistants

  1. For every programme (excluding Talk Shows, Interviews & Documentaries), a minimum of 6 light Assistants including a Generator Operator is to be used for every 20 KW Light use.

  2. For more than 20 KW use, one Light Assistant is to be used for every 5 KW of Light.

13. General Guidelines

  1. Providing transport in case of non-availability of public transport is the responsibility of the Producer.

  2. Work from 9 AM to 9 PM is to be treated as one and half shift.

  3. For shifts starting from 7 AM, the effective hours worked should be treated as from 6 AM.

14. Validity of the above Agreement

  1. This agreement is valid from 1st April 2003 to 31st March 2004.
